Same Herbicide Used in Chautauqua Lake Subject to Preliminary Injunction in Lake George

The planned use by the Lake George Park Commission of the chemical herbicide ProcellaCOR EC was shut down with the issuance of a preliminary injunction by New York State Supreme Court Justice Robert J. Muller.

The court granted the preliminary injunction because the petitioners demonstrated the likelihood of success on the merits and that there would be irreparable harm if the injunction was not granted. The court will ultimately have to determine whether or not to make the injunction permanent.

The court stated, “There is no removing the chemical from the Lake once it is introduced.”

Concerns raised about ProcellaCOR at Lake George are concerns we have for Chautauqua Lake:

  • The circulation in the lake causes the herbicide to move beyond the application areas.
  • The herbicide is not selective for the targeted Eurasian milfoil only, it kills beneficial native plants too.
  • Everyone’s objections to the use of this herbicide should be heard.
  • This herbicide was just approved by NYSDEC in 2019. The long-term effects of this herbicide are not known.  More studies need to be done before allowing this herbicide  to be applied to lakes

Chautauqua Lake is our treasure! Nearly 400 acres were permitted to be treated here with ProcellaCOR EC on June 13 and 14. The exact number of acres treated has not been published as of this date.  For just under 8 acres of requested treatment, the Lake George community filed this action.
